Spam Policy
NAVIO SYSTEMS, SPAM POLICY ("Spam Policy")
EFFECTIVE 31 AUGUST 2004
Spam Policy
Navio encourages you to use our service as long as you abide by the Navio Terms of Use Agreement and Navio's prohibition on spamming and unethical marketing activities. The following are some examples of spamming that may violate the Terms of Use Agreement and Navio's Spam Policy:
- Manipulating identifiers, such as email headers, to disguise the origin of any content transmitted to or through Navio computer systems.
- Relaying email from a third party's mail servers without the permission of that third party.
- Using or causing to be used Navio computer systems to facilitate the transmission of unsolicited or unauthorized material, except as expressly allowed under Sharing. This includes any promotional materials, URLs, "junk mail," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation that you may upload, post, email, transmit, or otherwise make available.
- Using "robots" or otherwise harvesting other's email addresses from the Navio site for purposes of sending unsolicited or unauthorized material.
- Uploading, posting, emailing, or transmitting the same message, URL, or post multiple times.
- Disrupting the normal flow of dialogue, or causing the screen to "scroll" faster than other users of the service are able to type, or otherwise acting in a manner that negatively affects other users' ability to engage in real-time exchanges.
Certain Navio services may have additional spam guidelines explaining appropriate conduct for those services. Those additional policies are incorporated by reference into the Navio Spam Policy. It is the user's responsibility to check each property's guidelines for additional details regarding spam.
Violations of our Terms of Use or this Spam Policy may result in legal action against you and the termination, without notice, of your Navio ID and/or anything associated with it, including, but not limited to, digital content rights collections. Nothing in this policy is intended to grant any right to transmit email to or through Navio computer systems. Navio does not waive any rights by the failure to enforce this policy in every instance in which it might apply.
NOTICE: Sending unsolicited email advertisements to or through Navio computer systems will use or cause to be used Navio servers located in California. Any unauthorized use of Navio computer systems is a violation of the Navio Terms of Service, Universal Spam Policy, and certain federal and state laws, including the Computer Fraud and Abuse Act (18 U.S.C. ¤ 1030 et seq.), Section 502 of the California Penal Code, and Section 17538.45 of the California Business and Professions Code. Such violations may subject the sender and his or her agents to civil and criminal penalties.
Sharing
Navio promotes having users of the AV Network introduce new users to the AV Network. Navio allows users to select items in their digital collection and "share" that item with friends. This act of sharing may be restricted by the Merchant from which the content originated. Sharing an item may include, but not be limited to, (a) sharing an offer to preview / buy the item to a friend or group of friends, (b) sharing a copy of the item to a friend or group of friends, or (c) transferring rights to own the item to a friend.
In all cases, sharing is intended solely amongst personal contacts of the AV Network user. Users are prohibited from using the AV Network sharing feature from making unsolicited offers to harvested or purchased email addresses or mobile phone numbers. Violation of this policy is grounds for user account termination and seizure of all rights to collected content, including whether the collected content is digital cash or currency.
